Liability Waiver, Assumption of Risk, and Release of Liability

DeMado Enterprises, LLC (DBA: Tumble Tikes – Party + Play Gym and Triple Jump Fitness)

Tumble Tikes – Party + Play Gym and Triple Jump Fitness offer movement-based programs including tumbling, gymnastics, sports, dance, music, fitness, camps, workshops, and private parties. These programs are led by qualified instructors and coaches; however, they are not intended as a substitute for professional medical, therapeutic, or developmental advice. Each child is unique, and all guidance provided should be supplemented with input from your licensed healthcare provider.

While we take every precaution to maintain a safe environment, participation in any class or event at our rented facility involves inherent risks, including the risk of serious personal injury or property damage (“Injuries and Damages”). These may result from physical activity, equipment use, or the condition of the premises. By choosing to participate, you acknowledge and accept these risks.

Participation and Medical Responsibility

1. If my child or I am participating in tumbling, sports, games, camps, parties, dance, music, fitness classes, or workshops offered by Tumble Tikes or Triple Jump Fitness, I understand that these activities involve physical exertion that may be strenuous and carry risks of injury. I acknowledge that I am fully aware of the potential hazards involved.

2. I understand it is my responsibility to inform my Tumble Tikes instructor or TJF coach of any serious illness, injury, or physical limitation prior to each class or session. I agree not to engage in any activity that could cause further harm or discomfort.

3. I confirm that I, or my child, have consulted with a physician regarding participation in these programs and represent that we are physically fit and free of any condition that would prevent safe and full participation.

4. By participating in programs at Tumble Tikes or Triple Jump Fitness, I agree to assume full responsibility for any and all risks, injuries, or damages—known or unknown—that may be incurred through participation.

Waiver and Release

5. In consideration of being permitted to participate, I knowingly and voluntarily waive any present or future claim I may have against Tumble Tikes, Triple Jump Fitness, their officers, employees, or agents, for any injuries or damages resulting from participation.

6. I, on behalf of myself, my child, my heirs, and legal representatives, agree to forever release, discharge, and hold harmless Tumble Tikes and Triple Jump Fitness from any claims or legal action, including those arising from negligence or other acts.

Class Policies

7. Absences and Makeup Policy: Refunds are not provided for missed classes due to illness, weather, or holidays. However, participants may schedule up to two (2) makeup classes per session, subject to availability. Makeup classes are not guaranteed and must be scheduled within the same session. Rollovers to future sessions are not permitted.

8. Behavioral Policy: Tumble Tikes reserves the right to revoke a child’s enrollment if their behavior is deemed unsafe for themselves or others in the class environment.

Final Acknowledgement

By signing below, I confirm that I am the parent and/or legal guardian of the participating child. I consent to my child’s full participation in Tumble Tikes and/or Triple Jump Fitness programs. I have read and fully understand this Liability Waiver, Assumption of Risk, and Release of Liability, and I voluntarily agree to its terms.
